Welcome to Thumbeza Leasing (Pty) Ltd, an e-commerce platform providing rent-to-own cellphones, laptops, and other electronic devices to customers across South Africa. By using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before making any purchase.

1. Definitions

• "Customer" or "You" refers to any individual or entity purchasing or renting products from Thumbeza Leasing (Pty) Ltd.
• "We," "Us," or "Company" refers to Thumbeza Leasing (Pty) Ltd, its subsidiaries, and affiliates.
• "Products" refers to cellphones, laptops, and other electronic devices offered on our platform.
• "Rent-to-Own" refers to the payment plan allowing customers to own the product after completing the agreed payment period.

2. Eligibility

To use our services, you must:

• Be at least 18 years old.
• Have a valid South African ID, Passport, or Asylum.
• Provide proof of residence.
• Provide accurate and complete information during the registration and purchase process.

3. Product Availability

All products listed on our website are subject to availability. We reserve the right to limit the quantity of products we supply, discontinue any product, or refuse service to any customer at our discretion.

4. Pricing and Payment Terms

• Pricing: All prices are listed in South African Rand (ZAR) and include VAT unless otherwise specified.
• Payment Plans: We offer flexible rent-to-own payment plans. The terms of each plan, including the duration and monthly instalment, will be clearly outlined before you commit to a purchase.
• Payment Methods: Payments can be made via debit order, EFT, or credit card. The first payment will be due upon signing the rent-to-own agreement and/or agreeing to the terms and conditions.

5. Rent-to-Own Agreement

• Ownership: Ownership of the product will transfer to you only after all payments have been completed according to the rent-to-own plan.
• Default: If you fail to make payments as agreed, we reserve the right to reclaim the product and terminate the agreement. Late payment fees may apply.
• Termination: You may terminate the agreement within 7 days by returning the product in good working condition and with all accessories and the original product packaging. You will not be entitled to a refund of payments already made.

6. Delivery

• Delivery Time: We aim to deliver products within 2-10 working days from the date of order confirmation, subject to product availability and location.
• Delivery Fee: There is no delivery fee for orders within South Africa.
• Risk of Loss: Risk of loss or damage to the product passes to you upon delivery.

7. Warranty and Returns

• Warranty: All products come with a standard six-month warranty, covering manufacturing defects. Extended warranties may be available for depending on product and original manufacturer.
• Returns: Products may be returned within 7 days of delivery, provided they are in original condition, with all packaging and accessories. Return shipping costs will be borne by the customer unless the product is defective.

8. Limitation of Liability

Thumbeza Leasing (Pty) Ltd will not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our products or services. Our liability is limited to the purchase price of the product.

9. Data Protection and Privacy

We are committed to protecting your personal information. By using our services, you agree to our Privacy Policy, which outlines how we collect, use, and protect your data.

10. Governing Law

These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the South African courts.
